PRAGUE, Okla. – A lawsuit against two oil companies is able to move forward, thanks to the Oklahoma Supreme Court.
In 2011, Sanda Ladra says she was watching television when a 5.7 magnitude earthquake rattled her home.
Ladra says that after three years, she was still experiencing knee pain.
She decided to file a lawsuit against two oil companies, who she says caused the earthquake.
The lawsuit claims that disposing of wastewater related to the fracking process done by New Dominion LLC, based in Oklahoma City and Spess Oil Company, based in Cleveland, Oklahoma, are causing shifts in fault lines resulting in earthquakes.
“It’s the injection well activity, the disposal of the wastewater that is the problem,” Poynter says.
However, New Dominion and Spess Oil argued that they could not be sued because the Corporation Commission is responsible for claims involving oil and gas damages.
On Tuesday, the Oklahoma Supreme Court ruled 7-0 that Ladra could sue the companies.
