OKLAHOMA CITY – A scuffle in the Groovy’s parking lot turned into an early Friday morning shooting, leaving the victim seriously injured.
“The person who ultimately was arrested, Jay Silvernail, was in the parking lot. He was actually being held at gunpoint by another person there,” Msgt. Gary Knight, with the Oklahoma City Police Department, said.
Officers arrived on scene just after 2 a.m. and although police say Silvernail wasn’t making any attempt to flee the scene, a witness stepped in to make sure he didn’t get away.
“The shooting occurred and then someone who witnessed it came up with a gun and held him at gunpoint and told him he wasn`t going to leave until police arrived,” Knight said.
Silvernail was booked into the Oklahoma County Jail and is charged with one count of assault with a deadly weapon.
This wasn’t Silvernail’s first time pulling the trigger.
“I got out of the car with the duffel bag, he was coming at me so I threw it at his face just to get a little space and my pistol just happened to be in my car in between the seats,” Silvernail told us almost a year ago.
In what he says was self-defense, Silvernail shot and killed his client David Smith.
“I can’t remember being any more terrified in my whole life,” Silvernail said at the time.
Officials with the Oklahoma County District Attorney’s Office said Silvernail clearly was defending himself in that case.
However, for now we don’t know much about what led up to this shooting.
“I don’t know what the motive for the shooting was, what led up to the altercation but we do know that he was involved in a scuffle or a fight with this person in the parking lot and then the shooting occurred,” Knight said.
At last check, the victim was still in the hospital with serious injuries.
