NORMAN, Okla. — An Oklahoma couple says they’re fighting a corporate giant after almost losing their home to CitiMortgage, Inc.
They’re now suing the company, alleging wrongful foreclosure.
“I’m going to fight. I’m just not going to sit here and take this. They can’t take my home without a fight. We love our home, we really do,” said Bob Neidhart.
Back in 2011, hard times hit the Neidharts. Sherry Neidhart became ill and had to quit her job.
Bob Neidhart had just retired.
They lived off of savings for a while, then realized they needed to discuss options with their mortgage company.
“They said not a problem, not a problem at all. We’ll just work with you,” said Bob Neidhart.
They entered into what’s called “forbearance” – making reduced monthly payments to CitiMortgage.
And since then, the Neidharts say they’ve never missed a payment.
They thought everything was fine, until they found out CitiMortgage had filed for foreclosure.
“All the time that I was cooperating and she was lying and deceiving me, they were working behind my back to take my home,” said Bob Neidhart.
The Neidharts hired an attorney and filed a counterclaim, alleging back faith.
“Corporate accountability, corporate responsibility is something that needs to be tried, and that’s what we’re going to do,” said the Neidharts’ attorney, Jeff Marr.
“It’s scary. It’s humiliating. It’s embarrassing,” said Bob Neidhart.
The Neidharts say they’re looking forward to their day in court.
“They lied and they cheated and stole. They’re thieves, that’s exactly, I’m sorry, but that’s the way I feel about it. They actually; behind the scenes, going against everything they said, to take my house,” said Neidhart.
CitiMortgage said they could not comment on this specific case because of privacy concerns.
But in scouring hundreds of pages of court documents, many CitiMortgage employees denied any wrongdoing in their depositions.
And their attorneys alleged that any violation of the Fair Debt Collection Practices Act was not intentional and resulted from an error.
CitiMortgage dismissed the foreclosure action back in January.
